Inspection of the technical condition and operation of a stationary solid-fuel combustion appliance pursuant to Section 17(1)(h) of the Air Protection Act No. 201/2012 Coll., as amended by Act No. 172/2018 Coll.

The obligation arising from the Act applies to every operator of a stationary solid-fuel combustion appliance with a total rated thermal input of 10 to 300 kW inclusive, which serves as a heat source for a hot-water central heating system. The operator is required to arrange, regularly at least once every threeyears, through a natural person who has been trained by the manufacturer of the combustion appliance and holds authorisation granted by the manufacturer for its installation, operation and maintenance (hereinafter "qualified person – QP"), an inspection of the technical condition and operation of the appliance, and to present, upon request, to the municipal authority of a municipality with extended powers a document confirming that this inspection has been carried out, issued by the QP. This document confirms that the stationary combustion appliance is installed, operated and maintained in accordance with the manufacturer's instructions and this Act. The quality of the combustion process is fundamentally affected by the technical condition of the appliance, the condition of the flue gas pathways, the quality of the fuel and the manner in which the appliance is operated. All of the above factors can significantly affect the amount of pollutants released into the air, which have a negative impact on health, particularly in the immediate vicinity of their source.

Under the Air Protection Act, the operator of an appliance means a legal or natural person who actually operates the appliance; if such a person is not known or does not exist, the owner of the stationary combustion appliance is deemed to be the operator. The obligation has been included in the Air Protection Act since 2012; however, in view of the transitional provision of Section 41(15), the operator of a stationary combustion appliance was required to ensure that the first inspection of the technical condition and operation of the appliance was carried out no later than 31 December 2016.

The provision of the Air Protection Act encompasses two obligations for operators of stationary combustion appliances with the characteristics described above. The first is the obligation to arrange, regularly at least once every three years, an inspection of the technical condition and operation of the stationary combustion appliance by a QP. The second obligation arising from this provision is the operator's duty to present, upon request, a document confirming that this inspection has been carried out to the municipal authority of a municipality with extended powers.
If the operator fails to arrange, regularly once every three years through a QP, an inspection of the technical condition and operation of this stationary combustion appliance, or fails to present, upon request to the municipal authority of a municipality with extended powers, confirmation that this inspection has been carried out as required by law, the operator risks being fined up to CZK 20,000 in the case of a non-business natural person, or up to CZK 50,000 in the case of a self-employed natural person or a legal entity.

1 The obligation applies not only to boilers but also to other stationary combustion appliances, such as stoves, fireplace inserts and fireplaces, provided they have a hot-water heat exchanger connected to a hot-water central heating system and their rated thermal input is 10 kW or more.
